Today, October 23rd, the NC Division of Water Quality issued a 401 Water Quality Certificate for the Alcoa Yadkin Project. This is the final step needed for the Federal Energy Regulatory Commission (FERC) to act upon Alcoa's application for relicensing. The Certificate has been tied up by legal actions taken by the Yadkin Riverkeeper and the McCrory Administration for years. Recent court decisions not only cleared the way for the Certificate, but mandated that the Division of Water Quality act upon Alcoa's application.
